Keys to the Grand Prix Prize Draw (the “Prize Draw”) Terms and Conditions

1.        The promoter of this Prize Draw is Formula One Management Limited of No. 2 St James’s Market, London, SW1Y 4AH (the “Promoter”).

2.        Subject to Paragraph 10 below, this Prize Draw is open to residents aged 16 and over of the UK, EU, USA and other territories where its operation and the Prizes are permitted. Where operation of this Prize Draw is not permitted by applicable law or regulation, this Prize Draw shall not be operated and residents of such jurisdictions are not permitted to enter.

3.        The Prize Draw is not open to: (a) employees, contractors or agents of the Promoter, their group companies or family members, freelance contributors, anyone else connected to the Prize Draw and their family members; or (b) public officials (as defined by applicable laws, statutes and regulations relating to bribery and corruption, including but not limited to the United States Foreign Corrupt Practices Act of 1977 and the UK Bribery Act 2010) and anyone connected to them.

4.      By entering the Prize Draw you are accepting these terms and conditions (the “Terms and Conditions”). These Terms and Conditions shall be effective for all entries into the Prize Draw.

5.      For the avoidance of doubt, the terms of use of formula1.com shall apply to your use of formula1.com.

6.       HOW TO ENTER

6.1     The Prize Draw will run from 16:00PM on 27 February 2023 (the "Opening Date") to 23:59PM on 12 March 2023 (the "Closing Date") inclusive. Entries received outside this time period will be void and will not be eligible to win any Prize.

6.2     In order to enter the Prize Draw participants must, prior to the Closing Date:

a)       visit  https://formula1.com/en/page.competition.html; and

b)      submit their name, email address, favourite team, favourite driver, residential address, contact telephone number and country of residence.

6.3   The winner and runners-up of the Prize Draw will be contacted via email. All participants must provide a valid email address at the time of entering the Prize Draw. Any entry received without a valid email address will be void and the relevant participant will not be eligible to win any Prize.

6.4   In entering the Prize Draw, participants confirm that they are eligible to do so. The Promoter may require you to provide proof that you are eligible to enter the Prize Draw.

6.5   No purchase is necessary to enter the Prize Draw and purchase of any item does not enhance your chance of winning.

6.7   Only one (1) entry per person is permitted. Entries on behalf of another person will not be accepted and joint submissions are not allowed. The winner or runners-up shall be the named respondents on the nine (9) randomly selected winning entries.

6.8     The Promoter accepts no responsibility for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt.

7.       PRIZES

7.1     There will be one (1) prize provided by the Promoter which shall consist of the following:

a)      two (2) economy class round-trip tickets from the most suitable international airport (as determined by the Promoter) located within the winner’s country of residence to Melbourne, Australia. Flights will arrive in Melbourne on or about 30 March 2023 and will depart Melbourne on or about 3 April 2023;

b)      four (4) nights hotel accommodation in Melbourne for two (2) (based on sharing/twin occupancy) for 30 March, 31 March, 1 April and 2 April 2023;

c)      two (2) three-day grandstand tickets in the ‘Fangio Grandstand’ at the Formula 1 Rolex Australian Grand Prix 2023 (the Event);

d)      the name of the winner and their accompanying guest each printed on a square of the chequered flag waved at the Event, which will be cut, framed and delivered to the winner and accompanying guest, such prize known formally as ‘Own the Chequered Flag’ – 2023 Formula 1 Australian Grand Prix’; and

e)      such other additional tours or passes in relation to the Event as determined by the Promoter, which may include without limitation any of the following: Broadcast Centre tour, Paddock tour, Photo Safari tour, subject to availability and provided at the Promoter’s discretion. Paragraphs 7.1(a) to (e) above together referred to as the Airline Prize.

7.2     There will be eight (8) runners-up prizes provided by the Promoter. Each runner up will be entitled to the relevant runner up’s name printed on a square of the chequered flag waved at the Event, which will be cut, framed and delivered to the runner up, such prize known formally as ‘Own the Chequered Flag’ – 2023 Formula 1 Australian Grand Prix’ (the “F1 Authentics Prize”), the Airline Prize and F1 Authentics Prize, each a “Prize” and together the “Prizes”.

7.3     By accepting the Airline Prize outlined in Paragraph 7.1 above, the winner agrees that:

a)            the selection of the airline and dates of travel (including departure and arrival times) are to be determined solely by the Promoter;

b)            any winner below the age of eighteen (18) must be accompanied by a parent, guardian or travel companion above the age of eighteen (18);

c)            the winner and their accompanying guest are solely responsible for obtaining all visas, permissions and other documentation required for entering and staying in Australia and shall provide to Promoter evidence of such confirmed visas, permissions as well as all other required travel documentation specified by the Promoter, no later than five (5) days of the winner being notified of their win;

d)            once the winner has provided their details and the details of their accompanying guest and Promoter has confirmed receipt of such details, no changes to the winner or accompanying guest is permitted without the prior written consent of the Promoter, and

e)            all elements of the Airline Prize must be redeemed at the same time, and if for any reason, the winner or accompanying guest does not redeem any or all elements of the Airline Prize, such elements shall be forfeited.

7.4     The Prizes listed in Paragraphs 7.1 and 7.2 above consist of the Prize only and do not any associated costs or expenses including travel insurance, cost of transfers to and from airports, stations or ports, any additional flights required for the winner and their accompanying guest to board the flights provided by Promoter as specified in Paragraph 7.1(a), food and drink, spending money, or personal expenses. Any costs incurred in addition to those expressly set out above and that are incidental to the fulfilment of the Prizes are the responsibility of the winner and runners-up.

7.5     The Promoter accepts no responsibility for any costs associated with the Prizes that are not expressly included above. The prize winner and runners-up are solely responsible for all applicable federal, state and local taxes, including customs duty, levies and/or other import fees to which any Prize may be subject, and any taxes imposed on their income.

7.6     The approximate retail value for the Prizes are as follows:

a)            in respect of the Airline Prize:

(i)       two (2) three-day grandstand tickets in the ‘Fangio Grandstand’ valued at AUD$1050;

(ii)     the names of the winner and accompanying guest on the chequered flag waved at the Event valued at £249 each;

(iii)    the value of the hotel accommodation and flights (as specified in Paragraph 7.1) will vary according to the flights and accommodation available at the time of booking;

(iv)    the additional tours or passes in relation to the Event are valued at £0 each; and

b)            in respect of the F1 Authentics Prize, the Prize is valued at £249.

7.7     All Prizes are non-exchangeable, non-transferable and not redeemable for cash or any other prize.  

7.8     The Promoter reserves the right to substitute the Prizes (or any part of the Prizes) with an alternative of similar value in the event that the original Prizes offered are not available.

7.9     The Prizes as set out above and awarded to the prize winner or runners-up shall not be used or dealt with in any way that is incompatible with any applicable laws, statutes and regulations relating to bribery and corruption, including but not limited to the United States Foreign Corrupt Practices Act 1977 and the UK Bribery Act 2010, and the prize winner or runners-up hereby acknowledges and agrees that no Prize issued pursuant to the these Terms and Conditions may be sold or offered for sale or other form of reward or incentive to any third party.

8.       WINNER AND RUNNERS-UP

8.1     There shall be one (1) winner who will win the Airline Prize who will be selected by way of a random draw from all entries received in accordance with these Terms and Conditions. The odds of winning will depend on the number of entries received.

8.2     There shall be eight (8) runners-up who will each win one (1) F1 Authentics Prize and each runner-up will be selected by way of a random draw from all entries received in accordance with these Terms and Conditions. The odds of winning will depend on the number of entries received.

8.3     The draw will be performed by a random computer process. The draw will take place remotely no later than 13 March 2023.

8.4     The winner and runners-up will be notified by email no later than 17 March 2023 and provided further details as to how they will be able to claim their Prize.

8.5     If a winner or runner-up does not respond to the Promoter within forty-eight (48) hours of being notified of their win, the winner or runner’s up Prize will be forfeited and the Promoter shall be entitled to select another winner or runner-up in accordance with the process described above (and that winner or runner-up will also have to respond to notification of their win within forty-eight (48) hours or else they will also forfeit their Prize). After this point, the Promoter will not select another winner or runner-up.

8.6     If a winner or runner-up rejects their Prize or the entry is invalid or in breach of these Terms and Conditions including for the avoidance of doubt, in the case of the winner, if the winner is unable to comply with Paragraph 7.3(c) above, the winner or runner’s up Prize will be forfeited, and the Promoter shall be entitled to select another winner or runner-up. If the newly selected winner or runner-up also rejects their Prize or their entry is invalid or in breach of these Terms and Conditions including in the case of the winner, if the winner is unable to comply with Paragraph7.3(c) above, the Promoter will not select another winner or runner-up.

8.7     The decision of the Promoter regarding any aspect of the Prize Draw is final and binding and no correspondence will be entered in to.

8.8     Proof that a valid winner and runners-up was awarded can be obtained after the date of the Prize Draw by sending a stamped addressed envelope to the Promoter, for the attention of Marek Borowik at address: No. 2 St James’s Market, London, SW1Y 4AH.

9.        Each winner and runner-up consents to (and the winner shall procure that their accompanying guest (as applicable) consents to) the use by the Promoter and its related companies, both before and after the Closing Date of the Prize Draw for an unlimited time, of the winner, runner-up or accompanying guest’s (as applicable) voice, still and moving images and name for publicity purposes (in any medium, including still photographs and films, and on the internet, including any websites hosted by the Promoter and its related companies) and in advertising, marketing or promotional material without additional compensation or prior notice and, in entering the Prize Draw, all entrants consent to the same.

10.     Residents of Tennessee or any other U.S. state or other jurisdiction in which it is unlawful to require agreement to a perpetual publicity release as a condition of winning a Prize shall not be bound by Paragraph 9 to the extent it is not lawful.

11.     The Promoter shall use and take care of any personal information you supply (or your accompanying guest (as applicable) supplies) in entering this Prize Draw as described in its privacy policy, a copy of which can be seen [https://account.formula1.com/#/en/privacy-policy] in accordance with data protection legislation and applicable law. By entering the Prize Draw, you agree to the collection, retention, usage and distribution of your (and your accompanying guest’s (as applicable)) personal information in order to process your entry to the Prize Draw,  contact you about your Prize Draw entry, deliver any Prizes, and for the purposes outlined in these Terms and Conditions. The information supplied by you in the associated entry form will be used as described on the entry form. Where a Prize is provided by a third party, you may be asked to provide your details to such third party in order for that third party to deliver your Prize.

12.     Where you have consented to receive marketing communications from any person other than the Promoter, your details may be passed to such person(s) and organisation(s) that you have consented to receiving marketing communications from.

13.     The Promoter accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you (or your accompanying guest as applicable) as a result of entering the Prize Draw or accepting the Prizes. The Promoter further disclaims any liability for any injury or damage to your or any other person’s computer relating to or resulting from participation in or downloading any materials in connection with the Prize Draw save to the extent that such liability results from (i) death or personal injury caused by the Promoter’s negligence; (ii) the Promoter’s fraud or fraudulent misrepresentation; or (iii) any other reason or by any cause which cannot be excluded by law.

14.     The Promoter reserves the right at any time and from time to time to modify, discontinue, temporarily or permanently, this Prize Draw with or without prior notice due to reasons outside its reasonable control (including, without limitation, in the case of anticipated, suspected or actual fraud). In the event that the Promoter permanently discontinues the Prize Draw pursuant to this Paragraph 14, the entrants in the Prize Draw shall be released from their obligations to the Promoter under these Terms and Conditions.

15.     The Promoter shall not be liable for any failure to comply with its obligations relating to this Prize Draw where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, epidemic, pandemic, supervening legislation or any other circumstances amounting to force majeure.

16.     The Prize Draw and these Terms and Conditions will be governed by English law and entrants to the Prize Draw submit to the jurisdiction of the English courts.  However, you may have statutory or legal rights in the territory where you live which could apply to your entry in the Prize Draw.
